The EU Commission has finalised guidance on the transparency obligations for providers and deployers of certain AI systems under the EU AI Act. The guidelines are complemented by a voluntary code of practice which can be used to demonstrate compliance.
The guidelines cover the four transparency obligations under Article 50, i.e:
- Providers must inform individuals where they are interacting with an AI system.
- Providers must ensure AI generated outputs are marked in a machine readable format and detectable as AI generated/manipulated.
- Deployers must advise individuals if emotion recognition or biometric categorisation is being used.
- Deployers must tell people where they are exposed to deepfakes or public interest publications without human review or editorial control.
