European Parliamentary Research Service reports on algorithmic discrimination under AI Act and GDPR

The European Parliamentary Research Service has issued a statement in relation to the potential conflict between the AI Act and GDPR in relation to the use of special category data to monitor, detect and correct bias in high risk AI systems, stating that reform of the GDPR or further guidelines on the interplay of the two regulations might be needed to deal with the fact that the legal restrictions on processing special category data under GDPR have lead to uncertainty as to whether the Legal bases are wide enough to allow for this processing in some circumstances.
