New Cross-border transfer rules in China

On 22 March 2024 the Cyberspace Administration of China finalised a new regulation which will govern cross-border data transfer.

It has been reported that these rules are less restrictive than the existing regime, providing exemptions and relaxations in relation to the use of approved transfer mechanisms in situations such as:

  • The transfer of personal data collected or generated outside of China
  • Transfers necessary for entering into or performing a contract (e.g. cross-border travel booking)
  • Transfers necessary for cross-border human resource management
  • Transfers necessary in an emergency to protect vital interests/property interests
  • Small volume transfers
