California Age-Appropriate Design Code (CAADC) is blocked by the judiciary

On 18 September 2023 the District Court of the Northern District of California (San Jose Division) granted a preliminary injunction in favour of NetChoice LLC (NetChoice) which prevents the Attorney General and “anyone acting in concert with his office” from enforcing the CAADC, having held that the NetChoice had shown a likelihood of success in its claim that CAADC violates the first amendment (freedom of speech) owing to the “speech restrictions” in the Act. The injunction will remain in place until NetChoice’s claim is decided in court. This is a significant blow for the Act as the ruling contained a thorough examination of NetChoice’s arguments.
