China proposes new data protection rules

It has been reported by a number of sources that China has proposed new rules in relation to data transfer. In general, the rules lighten the restrictions relating to transfer of personal data.

Some types of transfers will be exempt from China’s data transfer rules, including but not limited to international trade, data generated outside of China and transfers necessary for cross border e-commerce. There will be more clarity around what constitutes “important data” (which requires a transfer approval) and a reduction in the requirement for security assessments for transfers.

Commentators seem to welcome the move as decreasing the regulatory burden for international organisations sending information out of China.
