The French data protection authority, the CNIL, has issued a set of FAQ to support the recommendation it issued earlier this year in relation to tracking pixels.
The recommendation considers when tracking pixels need consent and the exemptions to this. The FAQ add to this by looking at:
- The scope of the recommendation – including the status of tracking links
- The responsibility of the actors in the chain- looking at email service providers
- Further detail on how to apply the exemptions (deliverability and security)
- Ways of obtaining consent to tracking pixels
- The application of the opt out period for email addresses collected before 14 April 2026
