Progress on the Digital Omnibus on AI is continuing at a pace with the European Parliament having agreed its position on the proposal. The European Parliament aligns with the Council of the European Union in asking for:
-
fixed dates for the entry into force of high risk provisions under the EU AI Act of 2 December 2027 for stand-alone high-risk AI systems and 2 August 2028 for high-risk AI systems embedded in products.
-
a standard of strict necessity (rather than necessity) for processing special category data to detect bias.
-
a ban on tools which will allow the creation of sexually explicit or intimate images resembling real people.
The European Parliament also proposes:
-
a commencement date of 2 November 2026 for the watermarking provisions on AI created content.
-
amendments to prevent the AI Act and product specific EU safety rules from overlapping.
-
the extension of certain support measures to small mid cap organisations.
