ICO seeks views on two new pieces of guidance for employers

The ICO has published two new pieces of draft guidance for consultation. The guidance relates to:

  1. Keeping employment records – This is a run-through of issues such as what records an employer might keep, lawful basis issues, storage limitation, accuracy, transparency, rights the employee has in relation to the records etc.
  2. Recruitment and selection – This guidance is split into two sections, the first, is an overview of how data protection law applies to processing candidates’ information for recruitment purposes. It looks at the data protection principles and the basics for compliance. The remaining guidance focuses on the specifics of the recruitment process. It looks at what the law requires employers to do and provides good practice advice.

The consultation is open until 5 March 2024. The draft guidance can be found here.
