£4.6m Grindr fine upheld by Norwegian courts

The Norwegian courts have upheld a fine of approximately £4.6m against Grindr (the largest fine issued by the Norwegian regulator), confirming that Grindr had not obtained valid consent for processing – making it impossible to use the app without accepting the processing.  This decision is appealable.

Against this background, a law firm in the UK has been building a claim in the English courts for the breach of English data protection laws alleging that Grindr shared sensitive personal data, including HIV status with advertisers. The Guardian reports that at least 670 people have joined the claim and thousands more have expressed an interest in joining.

This case may generate interesting issues in relation to the handling of group litigation claims for data protection law breaches and so may be interesting to watch.
