ChatGPT: Italian Data Protection Authority (DPA) notifies breaches of privacy law to OpenAI

In yet another installment of the Italian DPA’s case against ChatGPT, on 29 January 2024 the Italian DPA notified breaches of data protection law to OpenAI, the company behind ChatGPT.

On 30 March 2023, the Italian DPA imposed a temporary ban on processing of personal data by OpenAI. Based on the outcome of its “fact-finding” investigations, the Italian DPA has now concluded that there is evidence that ChatGPT has breached provisions of the EU GDPR and has published a statement on its website to that effect.

OpenAI may submit its defence concerning the alleged breaches within 30 days.
