Rules to strengthen cross border enforcement of GDPR are making their way through the legislative process

On 13 June 2024 the Council of the European Union reached agreement on a common position in relation to a proposed law on cross-border enforcement of the GDPR. The legislation aims to speed up the process of handling cross-border matters by harmonising the requirements for admissibility of a cross-border action, clarifying procedural deadlines and procedural steps of investigations and in relation to the adoption of the EDPB binding opinion. The idea is to encourage supervisory authorities to voice their opinions early in the enforcement procedure with the aim of finding an early consensus. The regulation will also harmonise the requirements and procedures in relation to the rights of complainants when their claim is rejected.

The council will now begin its negotiations with the European Parliament, which agreed its position on the text in April 2024.
